Slovenia becomes the sixth EU country to clear Tesla’s FSD, a month before the bloc votes

Tesla raises 2026 capex to $25 billion Credit: Milos Ruzicka via Shutterstock.com Slovenia has approved Tesla’s FSD Supervised, becoming the sixth European Union member state to let the driver-assistance system onto its roads. The timing is the point: an EU-wide vote that could open all 27 markets at once is expected in under a month. The approval was reported by Reuters on Tuesday. Tesla announced it in a post saying FSD Supervised was now approved in Slovenia and that rollout would begin soon, which Slovenia’s energy and infrastructure minister Jernej Vrtovec reposted with the words “Developing Slovenia”.

What Slovenia has not done is test the system. The route these approvals take is mutual recognition: the Dutch vehicle authority RDW issued the original certification, and under EU rules other member states can accept another country’s type approval and admit the certified system without repeating the assessment. That is how the Netherlands became the first in April and how Lithuania followed in May. Estonia, Denmark and Belgium make up the rest of the six.

Each of those yeses is a market, but none of them is the prize. Tesla is aiming at the European Commission’s Technical Committee on Motor Vehicles, where a vote on EU-wide approval of FSD Supervised is expected on 6 October. That vote needs a qualified majority: 55% of member states representing 65% of the bloc’s population. Six countries with a combined population of roughly 40 million do not get Tesla close to the second threshold on their own, but they change the room.

It is harder to vote against a system already legally operating in your neighbour’s traffic. It is worth being exact about what is being approved. FSD Supervised is a Level 2 system on the SAE scale. It steers, changes lanes and parks, and the person in the driver’s seat remains legally responsible for the vehicle at every moment.

Nothing in the Slovenian decision, or in the October vote, transfers liability from the driver to Tesla. The name has always run ahead of the classification. The practical stakes for owners are unusually front-loaded. The software is already installed on Teslas across Europe and is unlocked by regulatory permission rather than by any change to the car, which means a favourable vote converts into functioning driver assistance within weeks rather than model years.

It also means the six national approvals so far have produced a patchwork in which the same vehicle behaves differently depending on which border it has crossed, an outcome nobody designed and everybody is now using as an argument. The resistance has not vanished so much as softened. France raised safety concerns in July, particularly around how the system manages speed, and Sweden has been sceptical on the same grounds. France has since begun testing two FSD-equipped vehicles following what Reuters described as a constructive exchange with Musk.

Finland and Greece are considering approvals of their own. Tesla has spent the run-up building an evidentiary case, publishing a dataset drawn from its own European and North American testing to argue for bloc-wide clearance. The difficulty is that the data is the company’s. We have previously reported that Tesla gave European regulators misleading self-driving safety figures, and that its driver assistance is under scrutiny after two fatal crashes in which the vehicles stopped dead on the road.

Regulators voting in October will be weighing self-reported performance against an independent record that is thinner than either side would like. The strategy is legible enough. Collect national approvals through a recognition mechanism that does not require anyone to re-examine the system, arrive at the committee with the map already partly coloured in, and let momentum do work that argument might not. Whether it holds depends on whether the countries that have said nothing yet read six approvals as evidence or as a queue they have not joined.
